terms & conditions
1. About these terms
These Website Terms of Use apply to gdcaustralia.com.au and any associated webpages operated by Green Design and Construct (ABN 46 158 707 781), trading as GDC Australia (GDC, we, us or our). By accessing or using the website, you agree to these terms. If you do not agree, please do not use the website.
2. Information only — no offer or professional advice
The website provides general information about GDC, our capabilities, experience and services. It does not constitute a binding offer, quote, tender response, warranty or professional, technical, engineering, environmental, legal, financial or safety advice.
Project outcomes depend on site conditions, scope, approvals, design, specialist input, availability, budget and other factors. You should obtain advice appropriate to your circumstances and must not rely on website content as a substitute for site-specific assessment or formal project documentation.
3. Enquiries and service engagements
Submitting an enquiry, request for information or request for quote does not create a client, contractor, partnership, agency or other service relationship and does not require either party to proceed. Any services GDC agrees to provide will be governed by a separate written quote, work order, contract or other agreed terms. If there is any inconsistency, that separate agreement prevails for the relevant services.
4. Acceptable use
You must use the website lawfully and responsibly. You must not:
use the website in a way that infringes another person’s rights or breaches any law;
introduce malware, harmful code or material designed to disrupt, damage or gain unauthorised access to the website or related systems;
attempt to probe, test, bypass or interfere with security, access controls or network operation;
scrape, harvest or systematically extract website content or personal information, except as permitted by law or with our written consent;
impersonate another person, misrepresent your affiliation or submit false, misleading or unlawful material; or
use the website or its content to compete with GDC, create a derivative commercial database or send unsolicited communications.
We may restrict or block access where we reasonably believe these terms have been breached or the website, users or systems are at risk.
5. Intellectual property
Unless otherwise stated, GDC or its licensors owns the website and its content, including text, graphics, logos, photographs, video, layout and design, protected by intellectual property laws. You may view the website and download or print a reasonable copy for your own legitimate, non-commercial information or evaluation purposes.
You must not reproduce, adapt, publish, distribute, communicate, display, commercialise or otherwise use website content beyond that limited permission without prior written consent, except as allowed by law. GDC names, logos and branding must not be used in a way that suggests endorsement or affiliation without our written permission.
6. Your submissions
You are responsible for information and material you submit through the website. You warrant that you have the right to provide it and that it is accurate to the best of your knowledge, lawful and does not infringe another person’s rights.
You grant us a non-exclusive licence to use, copy and disclose your submission to the extent reasonably necessary to respond to you, assess an opportunity, deliver requested functions, protect our systems and comply with law. Personal information is handled in accordance with our Privacy Policy.
Do not submit confidential tender, security-sensitive, health or other sensitive information through a general website form unless we have asked you to do so or an appropriate secure channel has been agreed.
7. Third-party links and services
The website may contain links to, maps from, or embedded content supplied by third parties. These are provided for convenience and do not imply endorsement. We do not control third-party services and are not responsible for their availability, content, security, terms or privacy practices. Your use of them is at your own risk and may be subject to separate terms.
8. Website availability and changes
We may change, suspend or withdraw any part of the website without notice. We aim to keep content useful and current but do not promise that the website will always be available, secure, uninterrupted or error-free, or that all content is complete, accurate or current. Images and project examples may be illustrative, and services may vary by location and engagement.
9. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
To the maximum extent permitted by law, GDC excludes all other implied terms, representations and warranties relating to the website. Where our liability for a non-excludable guarantee can lawfully be limited, we limit it, at our option, to resupplying the relevant services or paying the cost of having them supplied again.
To the maximum extent permitted by law, GDC is not liable for indirect, consequential or special loss arising from use of, inability to use, or reliance on the website, including loss of profit, revenue, opportunity, data or goodwill. This limitation does not apply to liability that cannot lawfully be excluded or limited.
10. Privacy
Our Privacy Policy explains how we handle personal information collected through or in connection with the website. By using the website, you acknowledge that policy. Where consent is required for a particular collection or use, we will request it separately.
11. Changes to these terms
We may update these terms from time to time. The current version will be published on this page with its effective date. Changes apply from publication. If you continue to use the website after a change, the updated terms apply to that use.
12. Governing law
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
13. General
If any part of these terms is invalid or unenforceable, it is to be read down to the extent necessary or severed, and the remaining terms continue. A delay in exercising a right is not a waiver. Headings are for convenience only.
